Family law judge ends relationship with divorcing couple

A judge in Vancouver has recommended that a contentious divorce case be moved to a different court, according to local sources. The British Columbia couple has been engaged in a hostile divorce for some time now, and the judge presiding over the case believes a change in the bench might help bring an end to the difficult separation. While this is certainly unusual in the realm of family law, it is not unheard of for unique measures to be taken in contentious divorce cases.

The source of the couple's conflict seems to be the child custody case, in which both parties appear to believe they are acting in the child's best interests. However, it has led both of them to somewhat extreme measures, including considerable inter-family drama, which the court believes is impeding a resolution. Some family law experts have acknowledged the challenge of a custody battle while still recommending moderation and restraint on the parts of both parents.

This type of battle is not without precedent in British Columbia family law. In 2013, motions were passed to give judges more autonomy on dictating how contentious couples should be able to communicate. In some cases, particularly in cases where children are involved, some justices have recommended email-only communication, as well as separate parenting techniques. In this case, it appears more drastic measures have been taken to ensure the settlement of this particularly challenging divorce.

British Columbia residents who have experienced divorce, especially with minor children involved, understand that it can be a very difficult process. However, family law experts recommend keeping emotions in check while dealing with the legality of the situation, lest the separation draw ever longer, as is the case here. Seeking the support of qualified divorce professionals to aid in that process can be extremely helpful to both parties.
